SIRIUS and XM Recognize Additional Support for Merger
Think Tanks, Companies and Individuals File Supportive Comments with FCC on Monday Afternoon
NEW YORK, NY and WASHINGTON, DC — July 10, 2007 — XM Satellite Radio (NASDAQ: XMSR) and SIRIUS Satellite Radio (NASDAQ: SIRI) today commented on the additional support they have received for their merger. At the close of phase one of the Federal Communications Commission (FCC) public comment period on Monday afternoon, additional think tanks, companies and individuals filed supportive comments further demonstrating the widespread belief that the SIRIUS-XM merger is in the public interest and should be approved. The latest comments come on top of the more than 3,500 favorable comments from individuals and 20 prestigious organizations and businesses.
Among the additional supportive comments filed with the FCC on Monday afternoon were:

 Competitive Enterprise Institute
Ed Meese and Jim Gattuso at the
 Crutchfield Corporation
        Heritage Foundation
 Free State Foundation
   Loral Space & Communications
 Frank Sinatra Enterprises
   The Progress & Freedom Foundation
 Honda
   Steven Van Zandt
“The latest comments filed with the FCC echo the thousands of pro-merger comments that have already been filed and reflect the breadth and diversity of the support for our merger,” said Mel Karmazin, CEO of SIRIUS Satellite Radio. “SIRIUS and XM — and the many groups and people who support us — believe that the merger will lead to more choices and better pricing for consumers, and will create a stronger competitor in the rapidly evolving audio entertainment market.”
In filing their comments with the FCC, the third parties listed above have made a compelling case for the merger and the many ways it stands to benefit consumers. In announcing their support, they said:
“It is more than apparent to our company and our customers that this merger would benefit consumers immediately and in the long run by keeping access pricing affordable and is appropriate at this time.” (Honda, July 9, 2007)
“We believe that the merger of SIRIUS and XM will greatly benefit consumers... Frank Sinatra Enterprises strongly urges the FCC to approve the merger of SIRIUS and XM.” (Frank Sinatra Enterprises, July 5, 2007)

“We strongly believe that this merger will ensure that satellite radio remains a robust competitor in the audio entertainment market for years to come... In our view, the audio entertainment marketplace is a robust and expanding industry. We believe this merger would allow satellite radio to better compete against other listening options. For example, we understand that consumers will have the opportunity to receive more channels, including the best of SIRIUS and XM... We strongly urge the Commission to allow this merger to proceed without intervention, so that suppliers and consumers will be able to benefit from a more competitive and vigorous audio entertainment marketplace.” (Loral Space & Communications, July 9, 2007)
